Acceptance of Terms

By downloading, registering for, or using the DreamPlay.Africa platform ("Service"), you agree to be bound by these Terms and Conditions. If you do not agree, please refrain from using the Service.

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Taumina Holdings (Pty) Ltd, trading as DreamPlay.Africa ("DreamPlay.Africa", "we", "us", or "our"), a company duly registered and incorporated in accordance with the laws of the Republic of South Africa (Registration Number 2026/118514/07). By accessing or using the DreamPlay.Africa gaming platform ("Platform"), you agree to be bound by these Terms in their entirety.

IMPORTANT NOTICE: Certain provisions of these Terms are displayed in bold font. In accordance with section 49 of the Consumer Protection Act 68 of 2008, these bold provisions draw your attention to clauses that limit or exempt DreamPlay.Africa from liability or risk, require you to assume risk or liability, impose obligations to indemnify DreamPlay.Africa, require you to acknowledge any facts, or restrict, limit, or waive any rights you may have under these Terms. You are advised to read and understand these provisions carefully before accepting these Terms.

1. Definitions and Interpretation

1.1 In these Terms, unless the context indicates otherwise, the following words and expressions will bear the meanings assigned to them:

• "Account" means the personal user account created by a User upon registration on the Platform;
• "Coin" means the in-application virtual currency purchased by a User in bundles through the Platform. Coins are used for gameplay entertainment and digital utility, including avatars, extra lives, power-ups, additional game features, premium features and other digital utilities, and are not purchased solely to enter a Promotional Competition. The Coin denominations are Bronze (R0.10), Silver (R0.25), Gold (R0.75) and Platinum (R1.50).
• "Consumer Protection Act" or "CPA" means the Consumer Protection Act 68 of 2008, as amended from time to time;
• "Content" means all text, graphics, images, audio, video, software, data compilations, and any other form of information or material appearing on or accessible through the Platform;
• "Electronic Communication" means any communication by means of electronic data transmission, including the submission of competition entries via the Platform;
• "Electronic Communications and Transactions Act" or "ECTA" means the Electronic Communications and Transactions Act 25 of 2002;
• "Free User" means a User who accesses and uses the Platform without an active Subscription, including a User who receives advertisements and a daily allocation of free plays or Coins.
• "Intellectual Property" means all patents, trademarks, service marks, trade names, copyright, designs, know-how, trade secrets, and all other intellectual property rights, whether registered or unregistered;
• "Platform" means the DreamPlay.Africa gaming platform, accessible as a web application and at www.dreamplay.africa;
• "POPIA" means the Protection of Personal Information Act 4 of 2013, as amended from time to time;
• "Promotional Competition" means any competition conducted by DreamPlay.Africa on the Platform, entry to which is facilitated by electronic transmission;
• "Rewards" means any prizes, credits, vouchers, or other benefits earned by Users through gameplay or promotional activities on the Platform;
• "Subscriber" means a User with an active Subscription.
• "Subscription" means a User's enrolment in the single optional paid subscription offered by DreamPlay.Africa, available on a monthly or annual basis.
• "Subscription Fee" means the recurring fee payable by a Subscriber for the Subscription, being R29.99 per month or R199.99 per year, as selected by the Subscriber;
• "Transmission Cost" means the reasonable cost of electronic communication and data transmission required to submit a Promotional Competition entry, subject to the statutory maximum of R1.50 per entry and the substantiation requirements in clause 5;
• "User" means any natural person who accesses or uses the Platform, whether registered or unregistered.

1.2 In these Terms: (a) words importing the singular include the plural and vice versa; (b) words importing any gender include the other genders; (c) any reference to a statutory provision includes any subordinate legislation made under it and any amendment, modification, or re-enactment thereof; (d) clause headings are for convenience only and will not affect interpretation; (e) any reference to "days" means calendar days unless otherwise specified.

2. Eligibility and Registration

2.1 To register for and use the Platform, you must: (a) be a natural person of at least 18 (eighteen) years of age; (b) be a resident of the Republic of South Africa or such other jurisdictions as DreamPlay.Africa may permit from time to time; (c) possess a valid mobile telephone number or e-mail address and a compatible device; (d) provide accurate, current, and complete registration information; and (e) have the legal capacity to enter into a binding agreement.

2.2 You may register only one Account. Multiple accounts held by the same person are prohibited and may result in immediate termination of all such accounts.

2.3 You are solely responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account.

2.4 DreamPlay.Africa reserves the right to refuse registration, or to suspend or terminate any Account, in its sole discretion and without obligation to provide reasons.

2.5 You must notify DreamPlay.Africa immediately of any unauthorised use of your Account or any other breach of security of which you become aware.

3. Subscription and Coin Benefits

3.1 DreamPlay.Africa offers Free Users access to the Platform without a Subscription and offers one optional Subscription to Users. The applicable features, fees and access are summarised below:

3.2 All fees and Coin prices are quoted in South African Rand (ZAR) and are inclusive of value-added tax (VAT) where applicable.

3.3 Free Users may access and use the Platform without payment of a Subscription Fee. Free Users will be exposed to in-application advertisements and will receive a daily allocation of free plays or Coins.

3.4 Each Free User will initially receive 20 (twenty) complimentary plays per day for Bronze-level games. Free plays and Coins may be used for qualifying gameplay and can produce qualifying scores for a Promotional Competition. Any further Coin purchases are for gameplay entertainment and digital utility, not for the purchase of a chance to win.

3.5 The Platform includes a substantive free-to-play section offering games and entertainment features that do not carry Rewards or prizes. Access to those games and features is unlimited and does not require the purchase of Coins.

3.6 Subscription Fees are payable in advance on the commencement date and on each renewal date selected by the Subscriber, whether monthly or annually.

3.7 DreamPlay.Africa reserves the right to amend Subscription Fees and Coin prices from time to time upon not less than 30 (thirty) days' prior written notice to affected Users.

3.8 Users may commence, cancel or change the billing frequency of their Subscription at any time. A change from monthly to annual billing, or the other way around, will take effect at the commencement of the next billing cycle. The Subscription has standalone value independent of any prize or Promotional Competition, and access to selected Promotional Competitions is an incidental benefit rather than the primary reason to subscribe.

3.9 No refunds will be given for partial billing periods or for unused Coins, except as required by applicable law.

4. Gameplay and Rewards

4.1 DreamPlay.Africa operates primarily as a mobile gaming entertainment service. Users may play interactive games, develop and demonstrate skill, access social features, leaderboards, achievements and other entertainment content, and use Coins for gameplay entertainment and digital utility, including avatars, extra lives, power-ups, premium features and additional game features. Rewards and Promotional Competitions are secondary and incidental to that entertainment service.

4.2 The Platform is a gaming entertainment service providing Users with access to a variety of interactive games, social features, leaderboards, achievements, and other entertainment content. Promotional Competitions conducted on the Platform are incidental to, and conducted for the purpose of promoting, the gaming entertainment services offered by DreamPlay.Africa. For the avoidance of doubt, the primary purpose of the Platform is the provision of gaming entertainment services, and the Promotional Competitions do not constitute the core goods or services offered by DreamPlay.Africa.

4.3 Games available on the Platform are designed to incorporate elements of player skill, including but not limited to reaction time, strategic decision-making, pattern recognition, and problem-solving. The outcome of gameplay is not determined solely by lot or chance.

4.4 Rewards may be made available through skill-based gameplay, achievements, leaderboards, loyalty features and discrete Promotional Competition campaigns conducted from time to time. No User is guaranteed any Reward.

4.5 The nature, value, and availability of Rewards are determined by DreamPlay.Africa in its sole discretion and may be varied or withdrawn at any time without prior notice.

4.6 Rewards have no cash value unless expressly stated otherwise by DreamPlay.Africa. Where Rewards are redeemable for monetary value, the terms of such redemption will be specified at the time of the relevant promotion or campaign.

4.7 Rewards are personal to the User and are non-transferable unless DreamPlay.Africa expressly permits such transfer.

4.8 DreamPlay.Africa reserves the right to disqualify any User from receiving Rewards, and to reverse or withhold Rewards already credited, where there is reasonable suspicion of fraud, manipulation, collusion, or breach of these Terms.

4.9 Any tax liability arising from the receipt of Rewards will be the sole responsibility of the User.

5. Promotional Competitions

5.1 DreamPlay.Africa may from time to time conduct Promotional Competitions on the Platform, subject to the CPA (and in particular section 36 thereof), the regulations promulgated thereunder, and any other applicable legislation. Each Promotional Competition will be a discrete promotional campaign with defined opening and closing dates, rather than a permanent daily fixture. Promotional Competitions are conducted for the purpose of promoting DreamPlay.Africa's gaming entertainment services and are incidental to those services.

5.2 Entry to Promotional Competitions is facilitated through electronic means on the Platform. Where applicable, the competition mechanic may comprise skill-based gameplay to qualify for a Top 100, followed by random selection of a winner or winners from that Top 100. Paid and free gameplay may both produce qualifying scores, and no advantage may be conferred by paying that cannot also be achieved through free play.

5.3 In accordance with section 36(3)(a) of the CPA, DreamPlay.Africa does not require any consideration to be paid by or on behalf of any participant in a Promotional Competition, other than the Transmission Cost, being the reasonable cost of electronically transmitting an entry as contemplated in regulation 11(1) of the CPA Regulations. Coins are purchased and consumed for gameplay entertainment and digital utility; qualification for a Promotional Competition is an incidental consequence of gameplay. Each Promotional Competition will have a genuine free alternative method of entry, including free daily plays or Coins capable of producing qualifying scores. No portion of the Transmission Cost constitutes, directly or indirectly, consideration for a chance to win a prize.

5.4 Nature of Entry Cost — Electronic Transmission Fee

5.4.1 If DreamPlay.Africa charges any amount specifically in respect of submitting an entry into a Promotional Competition, the User acknowledges and agrees that such amount constitutes solely and exclusively the cost of the electronic communication and data transmission required to facilitate, process, and submit the User's entry into the Promotional Competition ("Transmission Cost"). Amounts paid for Coins used in gameplay are not charged solely for entry into a Promotional Competition.

5.4.2 The Transmission Cost covers the technological infrastructure, electronic processing, data handling, server communication, and digital delivery mechanisms necessary to receive, validate, record, and confirm the User's competition entry. DreamPlay.Africa will retain a credible cost breakdown supporting any amount charged as a Transmission Cost.

5.4.3 For the avoidance of any doubt, no portion of the Transmission Cost constitutes, directly or indirectly, consideration for a chance to win or any other prize. The Transmission Cost is payable exclusively for the electronic communication service required to submit the entry, irrespective of the outcome of the Promotional Competition. Bronze, Silver and Gold Coins are below the statutory R1.50 cap; any Platinum Coin amount used as a Transmission Cost must not exceed R1.50 and must be supported by a credible cost breakdown.

5.4.4 The User expressly acknowledges that any Transmission Cost is analogous to, and in the nature of, a cost of electronic communication as contemplated in section 36 of the CPA and the relevant regulations pertaining to Promotional Competitions, and is not a fee for gameplay, access to a Promotional Competition or a chance to win.

5.4.5 The Transmission Cost will not exceed the maximum prescribed cost of entry to a Promotional Competition as provided for in the CPA or regulations made thereunder, as amended from time to time. DreamPlay.Africa must be able to substantiate a credible cost breakdown for any Platinum Coin amount treated as a Transmission Cost.

5.5 Each Promotional Competition will be governed by specific rules prepared before the campaign begins and published on the Platform before its commencement. Those rules should ideally be accepted separately from these general Terms to reinforce the distinction between the gaming entertainment service and the incidental Promotional Competition. In the event of any conflict between these Terms and the specific competition rules, the specific competition rules will prevail in respect of that competition.

5.6 In compliance with section 36(5) of the CPA, the rules of each Promotional Competition will clearly state: (a) the benefit or competition to which the offer relates; (b) the steps required by a person to accept the offer or to participate in the competition; (c) the basis on which the results of the competition will be determined; (d) the closing date for the competition; (e) the medium through or by which the results of the competition will be made known; and (f) any person from whom, any place where, and any date and time on or at which a person may obtain a copy of the competition rules and a successful participant may receive any prize.

5.7 DreamPlay.Africa will publish the results of each Promotional Competition on the Platform within a reasonable time after the closing date and will notify winners by electronic communication.

5.8 Prizes in respect of Promotional Competitions are not transferable and may not be exchanged for cash unless DreamPlay.Africa expressly provides otherwise in the specific competition rules. No prize may be awarded to a director, member, partner, employee, agent or consultant of DreamPlay.Africa, a person who directly or indirectly controls or is controlled by DreamPlay.Africa, or the spouse, life partner, business partner or immediate family member of any such person, to the extent prohibited by applicable law.

5.9 DreamPlay.Africa reserves the right to cancel, postpone, or amend any Promotional Competition at any time, provided that any User who has already submitted an entry will be entitled to a refund of the Transmission Cost paid in respect of such entry.

5.10 DreamPlay.Africa will comply with all applicable legal requirements in respect of Promotional Competitions, including but not limited to preparing rules before each campaign, making those rules available to the National Consumer Commission and participants on request without cost, and filing competition documentation with the National Consumer Commission where required.

5.11 In compliance with regulation 11(5) of the CPA Regulations, DreamPlay.Africa will ensure that an independent accountant, registered auditor, attorney, or advocate oversees and certifies the conducting of each Promotional Competition.

5.12 DreamPlay.Africa will, in compliance with regulation 11(6) of the CPA Regulations, retain for a period of not less than 3 (three) years after the conclusion of each Promotional Competition: full details of DreamPlay.Africa, including identity or registration numbers, addresses and contact numbers; the competition rules; a copy of the offer to participate; the names and identity numbers of persons responsible for conducting the competition; a full list of prizes; representative marketing materials or electronic copies; a list of every instance in which the competition was marketed, including dates, medium and place; the names and identity numbers of persons responsible for selecting winners; acknowledgments of prize receipt, winner identity numbers and dates of receipt or proof of delivery; declarations made under oath or affirmation confirming that winners were not prohibited directors, members, partners, employees, agents, consultants or connected persons; the basis on which winners were determined; a summary of the winner-selection proceedings, including participants, date, place and whether proceedings were open to the public; the name and identity number of the independent person who oversaw the determination; the means and frequency of announcing winners; the names and identity numbers of winners; the dates on which prizes were handed over or paid; and records of steps taken where a winner could not be contacted or did not receive or accept a prize, including the reasons and steps taken to deliver or pay the prize.

5.13 DreamPlay.Africa will, upon written request by the National Consumer Commission, forthwith and at its own expense submit a report based on the records contemplated in clause 5.12 to the Commission.

6. Payment and Billing

6.1 All payments due under these Terms will be made through the payment methods made available on the Platform from time to time.

6.2 By providing payment information, you authorise DreamPlay.Africa (or its appointed payment service provider) to debit the applicable fees from your nominated payment method.

6.3 Subscription Fees will be debited automatically in advance on a recurring monthly or annual basis, according to the billing frequency selected by the Subscriber, unless and until the Subscription is cancelled by the User.

6.4 Each game played will require one Coin of the applicable denomination. Coins are purchased in bundles at the applicable rates of Bronze (R0.10), Silver (R0.25), Gold (R0.75) and Platinum (R1.50), and are held in the User's Account balance. Upon each game played, one applicable Coin will be debited from the User's balance. Coins may also be used for avatars, extra lives, power-ups, premium features, additional game features and other digital utilities.

6.5 In the event of a failed payment, DreamPlay.Africa may suspend access to paid features of the Platform until such time as the outstanding amount is received.

6.6 DreamPlay.Africa will not be liable for any fees, charges, or penalties imposed by your bank, mobile network operator, or payment service provider in connection with payments made to or through the Platform.

6.7 Users will be entitled to request and receive an electronic receipt or record of all payments made to DreamPlay.Africa.

7. Intellectual Property

7.1 All Intellectual Property in and to the Platform, including but not limited to the software, games, graphics, user interface, design elements, text, trademarks, logos, and all other Content, is and will remain the exclusive property of DreamPlay.Africa or its licensors.

7.2 Subject to your compliance with these Terms, DreamPlay.Africa grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your personal, non-commercial purposes.

7.3 You may not, without the prior written consent of DreamPlay.Africa: (a) copy, reproduce, modify, adapt, translate, or create derivative works of any Content; (b) reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Platform; (c) remove, obscure, or alter any proprietary notices or labels on the Platform; (d) use any Content for any commercial purpose; or (e) sublicence, lease, sell, or otherwise distribute access to the Platform or any Content.

7.4 Any feedback, suggestions, or ideas provided by Users to DreamPlay.Africa in relation to the Platform will become the exclusive property of DreamPlay.Africa, and DreamPlay.Africa will be free to use, reproduce, modify, and exploit such feedback without restriction or compensation.

8. User Conduct and Prohibited Activities

8.1 In using the Platform, you agree not to: (a) use the Platform for any unlawful purpose or in violation of any applicable law or regulation; (b) use any automated device, bot, script, or other mechanical or electronic means to interact with the Platform; (c) attempt to gain unauthorised access to any part of the Platform, other users' accounts, or any systems or networks connected to the Platform; (d) engage in any form of cheating, hacking, exploitation of bugs, or manipulation of game outcomes; (e) interfere with or disrupt the integrity or performance of the Platform or the data contained therein; (f) impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity; (g) harass, abuse, threaten, or defame any other User or any DreamPlay.Africa personnel; (h) use the Platform to transmit any malicious code, virus, worm, or other harmful software; (i) collude with other Users to manipulate gameplay outcomes or Rewards; or (j) engage in any activity that DreamPlay.Africa reasonably considers to be detrimental to the Platform, its Users, or the interests of DreamPlay.Africa.

8.2 DreamPlay.Africa reserves the right to investigate and take appropriate action against any User who violates this clause 8, including but not limited to removing Content, suspending or terminating the User's Account, reporting the User to law enforcement authorities, and pursuing civil remedies.

9. Privacy and Data Protection

9.1 DreamPlay.Africa is committed to protecting the privacy of its Users in accordance with the Protection of Personal Information Act 4 of 2013 ("POPIA") and all other applicable data protection legislation.

9.2 By using the Platform, you consent to the collection, processing, and storage of your personal information as described in the DreamPlay.Africa Privacy Policy, which is available on the Platform and forms an integral part of these Terms.

9.3 DreamPlay.Africa will process personal information only for the purposes for which it was collected, including: (a) the provision and administration of the Platform and your Account; (b) processing of payments and billing; (c) the administration of Promotional Competitions and distribution of Rewards; (d) communication with you regarding your Account, the Platform, and promotional offers; (e) compliance with legal and regulatory obligations; and (f) the improvement and optimisation of the Platform and our services.

9.4 DreamPlay.Africa will implement appropriate technical and organisational measures to protect personal information against unauthorised access, loss, destruction, or damage.

9.5 Users have the right to access, correct, and request the deletion of their personal information, subject to the provisions of POPIA. Such requests may be directed to the Information Officer at the contact details set out in clause 15.

9.6 DreamPlay.Africa will not disclose personal information to third parties except: (a) where required by law; (b) where necessary for the provision of services; (c) where the User has provided express consent; or (d) where the User has opted in, by means of a separate tick-box consent mechanism on the Platform, to permit DreamPlay.Africa to use and share the User's personal information for the purposes of new projects, market research, or disclosure to third parties. Users may withdraw their consent to the processing contemplated in sub-clause (d) at any time by updating their preferences on the Platform or by contacting DreamPlay.Africa at the details set out in clause 15.

10. Limitation of Liability

10.1 To the fullest extent permitted by applicable law, DreamPlay.Africa, its directors, officers, employees, agents, and affiliates will not be liable to any User for any: (a) indirect, incidental, special, consequential, or punitive damages; (b) loss of profits, revenue, data, goodwill, or business opportunities; (c) damages arising from reliance on any information obtained through the Platform; or (d) damages arising from interruption, suspension, or termination of the Platform or any part thereof, howsoever arising, whether in contract, delict, strict liability, or otherwise, even if DreamPlay.Africa has been advised of the possibility of such damages.

10.2 To the extent that DreamPlay.Africa is found liable to a User, DreamPlay.Africa's aggregate liability will be limited to the total amount of Subscription Fees and amounts paid for Coin purchases by that User to DreamPlay.Africa in the 3 (three) months immediately preceding the event giving rise to the claim.

10.3 Nothing in these Terms will exclude or limit liability for death or personal injury caused by negligence, fraud, or any liability which cannot be excluded or limited under applicable law, including the CPA.

11. Disclaimer of Warranties

11.1 The Platform is provided on an "as is" and "as available" basis without any warranties or representations of any kind, whether express, implied, or statutory.

11.2 Without limiting the generality of clause 11.1, DreamPlay.Africa does not warrant or represent that: (a) the Platform will be uninterrupted, error-free, secure, or free from viruses or other harmful components; (b) any defects or errors in the Platform will be corrected; (c) the Platform will meet your specific requirements or expectations; or (d) the results obtained from the use of the Platform will be accurate or reliable.

11.3 Any reliance placed by you on any information or Content available on the Platform is at your own risk.

11.4 This clause 11 will not affect any rights you may have as a consumer under the CPA which cannot be excluded or limited by agreement.

12. Termination and Suspension

12.1 You may terminate your Account at any time by following the account closure procedure on the Platform or by contacting DreamPlay.Africa at the details set out in clause 15.

12.2 Upon termination by a User: (a) the User's subscription (if any) will be cancelled at the end of the current billing period; (b) any unused Rewards will be forfeited unless otherwise required by applicable law; and (c) the User's access to the Platform will cease.

12.3 DreamPlay.Africa may suspend or terminate your Account immediately, without prior notice, if: (a) you breach any provision of these Terms; (b) DreamPlay.Africa reasonably suspects fraudulent, abusive, or unlawful activity on your Account; (c) DreamPlay.Africa is required to do so by law or regulation; (d) DreamPlay.Africa decides to discontinue the Platform or any part thereof; or (e) such suspension or termination is necessary to protect the interests of DreamPlay.Africa, other Users, or third parties.

12.4 DreamPlay.Africa will not be liable to you or any third party for any suspension or termination of your Account in accordance with this clause 12.

12.5 Clauses which by their nature are intended to survive termination will survive, including but not limited to clauses 7, 10, 11, and 14.

13. Amendments to Terms

13.1 DreamPlay.Africa reserves the right to amend, modify, or replace these Terms at any time in its sole discretion.

13.2 Where a material amendment is made, DreamPlay.Africa will notify Users by electronic communication or by prominent notice on the Platform not less than 14 (fourteen) days prior to the effective date of such amendment.

13.3 Your continued use of the Platform after the effective date of any amendment will constitute your acceptance of the amended Terms.

13.4 If you do not agree to any amendment, you must discontinue your use of the Platform and close your Account prior to the effective date of such amendment.

14. Governing Law and Jurisdiction

14.1 These Terms will be governed by and construed in accordance with the laws of the Republic of South Africa.

14.2 Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, will be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.

14.3 Nothing in this clause 14 will prevent DreamPlay.Africa from seeking urgent interim or interlocutory relief in any court of competent jurisdiction.

14.4 The parties agree that, prior to instituting formal legal proceedings, they will endeavour in good faith to resolve any dispute through negotiation within a period of 20 (twenty) business days from the date on which the dispute is first notified in writing.

15.2 Notices given by DreamPlay.Africa to Users will be deemed to have been received upon transmission by electronic communication to the User's registered e-mail address or mobile number.

16. General Provisions

16.1 Severability. If any provision of these Terms is found to be invalid, unlawful, or unenforceable by any court of competent jurisdiction, such provision will be severed from these Terms and the remaining provisions will continue in full force and effect.

16.2 Entire Agreement. These Terms, together with the Privacy Policy and any specific competition rules published on the Platform and accepted separately where applicable, constitute the entire agreement between you and DreamPlay.Africa in relation to your use of the Platform, and supersede all prior agreements, representations, and understandings, whether oral or written.

16.3 Waiver. No failure or delay by DreamPlay.Africa in exercising any right or remedy under these Terms will constitute a waiver of that right or remedy. Any waiver by DreamPlay.Africa must be in writing and will not constitute a continuing waiver.

16.4 Assignment. You may not assign, transfer, or delegate any of your rights or obligations under these Terms without the prior written consent of DreamPlay.Africa. DreamPlay.Africa may assign or transfer its rights and obligations under these Terms to any third party without your consent, provided that such assignment does not materially diminish the rights afforded to you under these Terms.

16.5 Force Majeure. DreamPlay.Africa will not be liable for any failure or delay in the performance of its obligations under these Terms to the extent that such failure or delay is caused by a Force Majeure Event, being any event beyond the reasonable control of DreamPlay.Africa, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government action, power outages, internet or telecommunications failures, pandemics, epidemics, or any other event of a similar nature.

16.6 Third Party Rights. These Terms do not confer any rights on any third party, whether under the common law or by statute.

16.7 No Partnership or Agency. Nothing in these Terms will be construed as creating a partnership, joint venture, employment relationship, or agency between you and DreamPlay.Africa.
